HIPAA, the "Privacy Rule" and You

This course meets the qualifications for continuing education credit in Law and Ethics for LMFTs as required by the California Board of Behavioral Sciences.


Dear Member,

HIPAA continues to influence and impact California law. In fact, CAMFT sponsored Assembly Bill 1178 (Hernandez) this year to amend California’s primary confidentiality law – the Confidentiality of Medical Information Act (CMIA). The bill addresses the issue of the dangerous patient and the generally recognized exception to confidentiality to avert danger to others. Curiously, this exception to confidentiality has never been included in the CMIA. The final language adopted in AB 1178, which will become law on January 1, 2008, is taken directly from HIPAA regulations. CMIA will finally contain this important exception to confidentiality. A related and somewhat similar exception is contained in the law related to psychotherapist-patient privilege.

More and more, and as predicted by many, HIPAA will continue to influence California law. Whether or not you are a HIPAA “covered provider,” it is important to understand HIPAA requirements (primarily the “Privacy Rule”) and to understand how they may impact upon California law and your practices and policies regarding confidentiality and privacy of patient information and records. Because of this growing influence of HIPAA on California law and psychotherapy practice, this test should be taken to either fortify your knowledge of HIPAA or to acquaint yourself with some of its basic provisions.

This continuing education self-assessment test, like the prior tests, is sponsored by CAMFT in partnership with Richard S. Leslie, J.D., who created the test and made it available to CAMFT. THERE IS NO PASSING OR FAILING SCORE.

  • CAMFT will send you the answers (including explanations), an evaluation form, and a certificate of course completion. You will earn two hours of self-study CE credits in Law and Ethics.

Remember: you can acquire all of the six-hour Law and Ethics continuing education requirement by taking these tests. It takes completion of three tests to achieve the mandatory six hours in Law and Ethics. Further, if you enjoy this manner of supplementing your understanding of legal and ethical issues, you may acquire more than six hours in this important aspect of practice.You are limited to a maximum of 18 hours in self-study per license renewal period.
