Patient Records - Legal and Ethical Considerations

This course meets the qualifications for continuing education credit in Law and Ethics for LMFTs and LCSWs as required by the California Board of Behavioral Sciences.
Continuing Education - Two hours of self-study in law and ethics.


Dear Member:

This test explores some basics of record keeping and an aspect of the subject that occurs rather suddenly and requires careful thought and good judgment on the part of the practitioner. Records are sometimes misplaced, lost, unexpectedly destroyed in a flood or fire, or stolen, as in this vignette. Each situation is different, and the approach taken by the affected practitioner or agency will necessarily vary. This factual vignette presents some challenging problems for the MFT involved and for those who choose to take this test. Thinking through a problem like the one presented by this test will help alert you to a variety of practice issues related to record keeping, including confidentiality concerns.

Record keeping is not as simple and concrete of a subject as are other areas of practice. There are not many laws and regulations that cover the subject matter and ethical standards are minimally informative or directive. This does not necessarily mean that there is anything wrong or lacking, it just means that the practitioner is given wide latitude to adopt practices that he or she determines is appropriate for the nature of the services provided and the kind of people he/she sees in his/her practice. It should be remembered, however, that good record keeping (accurate and thorough) helps both the patient and the therapist – in a variety of ways and in a variety of circumstances.

This continuing education self-assessment test, like the prior tests, is sponsored by CAMFT in partnership with Richard S. Leslie, J.D., who created the test and made it available to CAMFT. THERE IS NO PASSING OR FAILING SCORE.

  • CAMFT will send you the answers (including explanations), an evaluation form, and a certificate of course completion. You will earn two hours of self-study CE credits in Law and Ethics.

Remember: you can acquire all of the six-hour Law and Ethics continuing education requirement by taking these tests. It takes completion of three tests to achieve the mandatory six hours in Law and Ethics. Further, if you enjoy this manner of supplementing your understanding of legal and ethical issues, you may acquire more than six hours in this important aspect of practice.You are limited to a maximum of 18 hours in self-study per license renewal period.
