Treatment Records - Your Rights and Responsibilities

This course meets the qualifications for continuing education credit in Law and Ethics for LMFTs and LCSWs as required by the California Board of Behavioral Sciences.

Dear Member,

The records that you keep regarding the professional services you render to patients are of critical importance, both to you and to the patient. Therapists’ practices and procedures with respect to recordkeeping vary, both from practitioner to practitioner and from client to client. A failure to keep adequate records may result in liability of one kind or another for the therapist. What is “adequate” in a particular situation may not be adequate in a different situation. This test explores the area of law and practice dealing with treatment records, and does so from a number of perspectives. Suppose a new patient, quite well known and in a position of power, requests that you keep minimal records in order to protect the patient’s privacy. Can you lawfully agree to do so? Should you consistently seek to obtain prior mental health records at the earliest time practicable? What part of your records can be removed by you before complying with a patient’s request to see a copy of his or her records? What laws or ethical standards relate directly to patient records?

These questions, and others, are explored in this self-assessment test. Since your records may protect you from liability, or in some cases hurt you, it is important for you to be familiar with this subject matter. Just as psychotherapy is both an art and a science, so too is recordkeeping. In addition to the importance of the actual content of your records, it is important to learn well the various aspects of law that relate to access to patient records by others, whether by subpoena or otherwise. This test explores these various aspects of treatment records and your rights and responsibilities with respect to them.

This continuing education self-assessment test, like the prior tests, is sponsored by CAMFT in partnership with Richard S. Leslie, J.D., who created the test and made it available to CAMFT. THERE IS NO PASSING OR FAILING SCORE.

Remember: you can acquire all of the six-hour Law and Ethics continuing education requirement by taking these tests. It takes completion of three tests to achieve the mandatory six hours in Law and Ethics. Further, if you enjoy this manner of supplementing your understanding of legal and ethical issues, you may acquire more than six hours in this important aspect of practice. You are limited to a maximum of 18 hours in self-study per license renewal period, or 9 hours for your initial license renewal period.
