Treating Children of All Ages - Legal Issues

Dear Member,

The treatment of children involves a variety of legal issues that can arise during the ordinary course of one’s practice, and the law, in some respects, treats the treatment of children differently than it does adults. Issues such as consent to treat, psychotherapist-patient privilege, confidentiality, and access to records are just some of the issues that will be encountered when treating children. Additionally, California law regarding the mental health treatment of minors has recently undergone significant changes, resulting in greater access to treatment for many minors. This test is intended to alert you to some of these legal issues and to hopefully help you become familiar with these essential principles of law so that mistakes can be avoided or minimized.

Parents may be unaware of their child’s rights or their own rights as parents to authorize treatment, authorize the release of confidential information, or to access otherwise confidential information about their minor children, which may exist in the treatment records. Child custody disputes often pit parent against parent and require the therapist to skillfully navigate through such proceedings in order to protect the patient (the minor) – and themselves. You are invited to take this test and to hopefully hone or increase your knowledge of this important aspect of clinical practice.

This self-assessment test is sponsored by CAMFT in partnership with Richard S. Leslie, JD, and meets the qualifications for continuing education hours in Law and Ethics for LMFTs as required by the California Board of Behavioral Sciences. The challenging test questions are designed to be answered in a simple True/False format. To help ou with the testing process, CAMFT has put together resources to aid you when determining your answers.

There is no need to feel intimidated or embarrassed if you are not confident of the correct answers. You grade yourself. The goal is for you to learn what you know and what you don't know. A review of the evaluation forms submitted by prior test takes indicates unequivocally that participants find the tests to be effective and valuable learning tools. THERE IS NO PASSING OR FAILING SCORE.
