ELDER/DEPENDENT ADULT DEFINITION CLARIFICATION  

It has come to CAMFT’s attention that there is a discrepancy in law regarding the age for Elder and Dependent Adult services and investigations and the requirements for mandated reporters to report alleged elder and dependent abuse/neglect.  AB 135 changed the definitions of an “elder” and “dependent adult” for purposes of investigation or providing services under an Adult Protective Services program to: elder as a person who is 60 years of age or older and a dependent adult as a person who is between 18 and 59 years of age. It is unclear whether the law changes the reporting obligations for mandated reporters. CAMFT is currently addressing the discrepancy with various state agencies. In the interim, CAMFT recommends members to follow the law prior to the changes which defines an elder as 65 years or older and a dependent adult as a person who is between 18-64.  We will keep members appraised of any updates.
