NEW LAWS THAT WENT INTO EFFECT JULY 1, 2022

AB1184 - Health Plans and Confidentiality of Medical Information:
Effective July 1, 2022, health plans must establish protocols to allow enrollees receiving sensitive health care services, including mental health treatment, to receive those services without alerting the primary subscriber. For example, if an individual wanted to seek therapy services without their spouse knowing, the individual would be able to request that EOBs and other treatment-related communications from the plan be sent to a friend’s address, etc.

 

SB 221 - Timely Mental Health Care:
Effective July 1, 2022, the law sets clear timely access standards by requiring health plans to ensure follow-up appointments for ongoing, medically necessary behavioral health treatment. Health plans must ensure their enrollees receive nonurgent follow-up appointments with nonphysician mental health care or substance use disorder providers within 10 business days of the prior appointment for those undergoing treatment for ongoing mental health or substance use disorder conditions.
