DON'T FORGET TO GET INFORMED CONSENT FOR TELEHEALTH

During the height of the pandemic, Governor Newsom temporarily relaxed certain state privacy and security laws for healthcare professionals, including the statutory requirement that healthcare professionals – including MFTs – obtain either written or verbal consent to treat a patient via telehealth. The Governor has since rescinded the portion of the Executive Order suspending informed consent requirement. As of October 1, 2021, all MFTs who are providing telehealth services to patients are required to once again obtain either written or verbal (and documented) consent to treat patients via telehealth.
